Article D1142-19 of the French Labour Code

Any differences in the representation of men and women mentioned in article D. 1142-16, as well as the way in which they are published, are sent to the services of the Minister for Employment using a remote declaration procedure defined by order of the Minister for Employment.

This information is also made available to the Social and Economic Committee under the conditions set out in the second paragraph of article L. 2312-18.

In the event that all or some of the differences in representation cannot be calculated, the transmission of the information provided for in this article to the departments of the minister responsible for labour and to the social and economic committee shall be accompanied by details explaining why the differences could not be calculated.

Les écarts éventuels de représentation entre les femmes et les hommes mentionnés à l’article D. 1142-16, ainsi que leurs modalités de publication, sont transmis aux services du ministre chargé du travail selon une procédure de télédéclaration définie par arrêté du ministre chargé du travail.

Ces informations sont également mises à la disposition du comité social et économique dans les conditions prévues au deuxième alinéa de l’article L. 2312-18.

Dans le cas où l’ensemble ou certains des écarts de représentation ne peuvent pas être calculés, la transmission des informations prévues au présent article aux services du ministre chargé du travail et au comité social et économique est accompagnée des précisions expliquant la raison pour laquelle les écarts n’ont pas pu être calculés.
