Article D1221-15 of the French Public Health Code

Blood and its components may only be used to prepare in vitro diagnostic medical devices if the results of the tests and analyses provided for in b, c and d of 5° of Article D. 1221-6 are negative.

However, an in vitro diagnostic medical device may be manufactured from a sample containing one or more antibodies or antigens sought by the tests and analyses mentioned in the above paragraph and necessary for the use of this in vitro diagnostic medical device.

Le sang et ses composants ne peuvent être utilisés en vue de préparer des dispositifs médicaux de diagnostic in vitro que si les résultats des tests et analyses prévus aux b, c et d du 5° de l’article D. 1221-6 sont négatifs.

Toutefois, un dispositif médical de diagnostic in vitro peut être fabriqué à partir d’un prélèvement contenant un ou plusieurs anticorps ou antigènes recherchés par les tests et analyses mentionnés à l’alinéa ci-dessus et nécessaires à l’usage de ce dispositif médical de diagnostic in vitro.
