Article D1235-21 of the French Labour Code

The scale mentioned in the first paragraph of article L. 1235-1 is defined as follows:

two months’ salary if the employee has been with the employer for less than one year;

-three months’ salary if the employee has been with the employer for at least one year, plus one month’s salary for each additional year of service up to eight years;

ten months’ pay if the employee has been with the employer for between eight and less than twelve years;

– twelve months’ pay if the employee has been with the employer for between twelve and less than fifteen years;

-fourteen months’ pay if the employee has been with the employer for between fifteen and less than nineteen years;

-sixteen months’ pay if the employee has been with the employer for between nineteen and less than twenty-three years;

eighteen months’ pay if the employee has been with the employer for between twenty-three and less than twenty-six years;

-eighty months’ pay if the employee has been with the employer for between twenty-six and less than thirty years;

-twenty-four months’ salary if the employee has been with the employer for at least thirty years.

Le barème mentionné au premier alinéa de l’article L. 1235-1 est défini comme suit :


-deux mois de salaire si le salarié justifie chez l’employeur d’une ancienneté inférieure à un an ;


-trois mois de salaire si le salarié justifie chez l’employeur d’une ancienneté au moins égale à un an, auxquels s’ajoute un mois de salaire par année supplémentaire jusqu’à huit ans d’ancienneté ;


-dix mois de salaire si le salarié justifie chez l’employeur d’une ancienneté comprise entre huit ans et moins de douze ans ;


-douze mois de salaire si le salarié justifie chez l’employeur d’une ancienneté comprise entre douze ans et moins de quinze ans ;


-quatorze mois de salaire si le salarié justifie chez l’employeur d’une ancienneté comprise entre quinze ans et moins de dix-neuf ans ;


-seize mois de salaire si le salarié justifie chez l’employeur d’une ancienneté comprise entre dix-neuf ans et moins de vingt-trois ans ;


-dix-huit mois de salaire si le salarié justifie chez l’employeur d’une ancienneté comprise entre vingt-trois ans et moins de vingt-six ans ;


-vingt mois de salaire si le salarié justifie chez l’employeur d’une ancienneté comprise entre vingt-six ans et moins de trente ans ;


-vingt-quatre mois de salaire si le salarié justifie chez l’employeur d’une ancienneté au moins égale à trente ans.
