Article D1272-4 of the French Labour Code

If, at the time of recruitment, an employment contract has been signed in accordance with articles L. 1221-1 to L. 1221-5 and articles L. 1242-12 to L. 1242-13, in the case of a fixed-term employment contract, or article L. 3123-6, in the case of a part-time employment contract, the clauses contained in this contract apply in place of the information in the employee identification declaration mentioned in Article D. 133-13-1 of the Social Security Code.

Si, lors de l’embauche, un contrat de travail a été signé dans les formes prévues aux articles L. 1221-1 à L. 1221-5 ainsi qu’aux articles L. 1242-12 à L. 1242-13, s’il s’agit d’un contrat de travail à durée déterminée, ou à l’article L. 3123-6, s’il s’agit d’un contrat de travail à temps partiel, les clauses contenues dans ce contrat s’appliquent en lieu et place des mentions de la déclaration d’identification du salarié mentionnée à l’ article D. 133-13-1 du code de la sécurité sociale .
