The bank charges levied by the drawee for the rejection of a cheque for insufficient or no funds include all sums invoiced by the drawee to the account holder, regardless of the denomination and justification of these sums.
In particular, the costs generated by the drawee’s obligation, under article L. 131-73, to inform the account holder of the lack of funds are included in the costs mentioned in the first paragraph once a payment incident has occurred. The cost of sending an injunction letter or a cheque incident or rejection commission is also included in these same charges.
Bank charges levied by the drawee when a cheque is rejected may not exceed €30 for cheques of €50 or less and €50 for cheques of €50 or more.
The rejection of a cheque presented for payment several times within 30 days of the first rejection constitutes a single payment incident.
