I-The theoretical maximum use of a swimming pool, corresponding to the capacity of the pool enclosure, is three people per 2 square metres of open-air water and one person per square metre of covered water. The surface area of diving or snorkelling pools permanently reserved for this purpose is not taken into account when determining the surface area of water areas.
The person in charge of the swimming pool must set the following figures and display them at the entrance to the pool:
1° The maximum instantaneous attendance at the pool, distinguishing between the maximum instantaneous capacity of swimmers within the pool enclosure, which may not exceed the theoretical maximum attendance at the pool, and the maximum instantaneous capacity of other people;
2° The maximum daily attendance at the pool, corresponding to the maximum daily capacity of people present within the pool enclosure.
II. -The maximum instantaneous number of bathers in whirlpool baths is visibly displayed near the pool. A whirlpool bath is a specific pool with seated or semi-recumbent areas, used for leisure or well-being, and equipped with a specific air, water or air and water injection device.
The minimum volume of water per bather in a whirlpool bath is set by an order of the Ministry of Health.
III. -In the vicinity of whirlpool baths, a warning not to exceed 15 minutes’ use and advising against access by children under the age of ten is displayed.
IV – The provisions of I and II do not apply to the facilities mentioned in IV of article D. 1332-4, with the exception of the first paragraph of I which applies to the facilities mentioned in 1° of IV of article D. 1332-4.
