Article D1445-1 of the French Public Health Code

For the application of the provisions of this code in Martinique and unless otherwise provided:

1° The reference to the department or region is replaced by the reference to the territorial collectivity of Martinique;

2° The reference to the departmental council or the regional council is replaced by the reference to the assembly of Martinique;

3° The reference to the President of the Departmental Council or the President of the Regional Council is replaced by the reference to the President of the Executive Council of Martinique for the powers devolved to the executive authority of the collectivity and by the reference to the President of the Assembly of Martinique for the powers linked to the presidency of the deliberative assembly;

4° The reference to departmental councillors or regional councillors is replaced by the reference to councillors to the Assembly of Martinique;

5° The reference to the Prefect of the Department is replaced by the Prefect of the Region of Martinique;

6° The words “départemental”, “régional”, “départementaux” and “régionaux” are replaced by the words “territorial” and “territoriaux” respectively.

Article D1445-1

Pour l’application des dispositions du présent code en Martinique et sauf dispositions contraires :

1° La référence au département ou à la région est remplacée par la référence à la collectivité territoriale de Martinique ;

2° La référence au conseil départemental ou au conseil régional est remplacée par la référence à l’assemblée de Martinique ;

3° La référence au président du conseil départemental ou au président du conseil régional est remplacée par la référence au président du conseil exécutif de Martinique pour les attributions dévolues à l’autorité exécutive de la collectivité et par la référence au président de l’assemblée de Martinique pour les attributions liées à la présidence de l’assemblée délibérante ;

4° La référence aux conseillers départementaux ou aux conseillers régionaux est remplacée par la référence aux conseillers à l’assemblée de Martinique ;

5° La référence au préfet de département est remplacée par la référence au préfet de région de la Martinique ;

6° Les mots : “ départemental ”, “ régional ”, “ départementaux ” et “ régionaux ” sont respectivement remplacés par les mots : “ territorial ” et “ territoriaux ”.
