Article D16 of the French Code of Criminal Procedure

The investigation into the personality of the persons under investigation as well as their material, family or social situation provided for in Article 81, paragraph 6, of the Code of Criminal Procedure and the examinations, particularly medical and medico-psychological, mentioned in paragraph 7 of the said article, constitute the personality file of the person under investigation.

The purpose of this file is to provide the judicial authority, in an objective form and without drawing any conclusions affecting the case in hand, with elements of appreciation of the past and present lifestyle of the person under investigation.

It cannot be intended to seek evidence of guilt.

Article D16

L’enquête sur la personnalité des personnes mises en examen ainsi que sur leur situation matérielle, familiale ou sociale prévue à l’article 81, alinéa 6, du code de procédure pénale et les examens, notamment médical et médico-psychologique, mentionnés à l’alinéa 7 dudit article, constituent le dossier de personnalité de la personne mise en examen.

Ce dossier a pour objet de fournir à l’autorité judiciaire, sous une forme objective et sans en tirer de conclusion touchant à l’affaire en cours, des éléments d’appréciation sur le mode de vie passé et présent de la personne mise en examen.

Il ne saurait avoir pour but la recherche des preuves de la culpabilité.
