Article D2261-12 of the French Labour Code

If, following the registered letter or the notification referred to in Article D. 2261-11, the organisation fails, without legitimate reason, to comply with the new summons sent to it, the Minister responsible for labour or his representative, who chairs the joint committee, will draw up a report and send it to the public prosecutor.

Article D2261-12

Si, à la suite de la lettre recommandée ou de la notification mentionnée à l’article D. 2261-11, l’organisation s’abstient, sans motif légitime, de déférer à la nouvelle convocation qui lui a été adressée, le ministre chargé du travail ou son représentant, président de la commission mixte, établit un rapport qu’il transmet au procureur de la République.
