When an extension or enlargement order is envisaged, it is preceded by the publication of a notice in the Journal officiel de la République française. This notice invites interested organisations and persons to make their observations known. It indicates the place where the agreement has been deposited and the department to which comments are to be submitted.
Interested organisations and individuals have fifteen days from publication of the notice to submit their observations.
When a request is made in application of the fourth paragraph of I of article L. 243-6-3 of the Social Security Code, it suspends the extension procedure initiated at the request of one of the representative employers’ or employees’ organisations mentioned in article L. 2261-19 as from receipt of the information mentioned in the fourth paragraph of II of article R. 243-43-2 of the Social Security Code.
If the organisation that submitted the request is different from the one that submitted the extension request, the competent minister will inform the latter of the suspension of the extension procedure. The Minister will inform the latter of the response from the Agence Centrale des Organismes de Sécurité Sociale or the Caisse Centrale de la Mutualité Sociale Agricole.
The organisation that submitted the request for extension has fifteen days following notification of the response from the agency or central fund or the date of receipt of the communication from the competent minister to state whether it maintains its request for extension.
If no reply is received within this period, the application is deemed to be maintained.
