Article D2362-12 of the French Labour Code

When an additional seat is allocated to a legal entity or natural person in application of article L. 2362-3 insofar as it refers to article L. 2352-4, this seat is allocated :

1° If there is a social and economic committee, to the trade union organisation that has the most representatives on this committee. In the event of a tie, the seat is awarded to the organisation that received the highest number of votes in the first ballot of the election of the members of this committee;

2° If there is no social and economic committee, to a representative elected directly for this purpose by the employees of the legal entity or natural person.

The election takes place in a single-round uninominal ballot.

Lorsqu’un siège supplémentaire est attribué à une personne morale ou personne physique en application de l’article L. 2362-3 en ce qu’il renvoie à l’article L. 2352-4, ce siège est attribué :

1° S’il existe un comité social et économique, à l’organisation syndicale qui compte le plus de représentants au sein de ce comité. En cas d’égalité, le siège est attribué à celle ayant recueilli le plus grand nombre de suffrages au premier tour de scrutin de l’élection des membres de ce comité ;

2° En l’absence de comité social et économique, à un représentant élu directement à cet effet par les salariés de la personne morale ou personne physique.

L’élection a lieu au scrutin uninominal à un tour.
