Article D3112-11-3 of the French Public Health Code

The amount of the fixed annual grant referred to inArticle L. 174-16 of the Social Security Code is determined by an agreement signed by the centre’s representative and the Director General of the Regional Health Agency before the end of the first quarter of the year for which the grant applies.

In the absence of an agreement between the Director General of the Regional Health Agency and the representative of the structure concerned, the territorially competent primary health insurance fund pays a provisional fraction of the allocation, the amount of which is equivalent to a quarter of the total amount of the allocation for the previous year. The Director General of the Regional Health Agency sets the final amount of the allocation before 30 April of the year in question and notifies it to the primary health insurance fund.

Le montant de la dotation forfaitaire annuelle mentionnée à l’article L. 174-16 du code de la sécurité sociale est déterminé par un accord signé entre le représentant du centre et le directeur général de l’agence régionale de santé avant la fin du premier trimestre de l’année au titre de laquelle s’applique la dotation.

En l’absence d’accord entre le directeur général de l’agence régionale de santé et le représentant de la structure concernée, la caisse primaire d’assurance maladie territorialement compétente verse une fraction prévisionnelle de la dotation, dont le montant équivaut à un quart du montant total de la dotation de l’année précédente. Le directeur général de l’agence régionale de santé fixe le montant définitif de la dotation avant le 30 avril de l’année concernée et le notifie à la caisse primaire.
