Pursuant to the fourth paragraph of article L. 3121-41 and the seventh paragraph of article L. 3121-44, overtime means hours worked :
1° More than thirty-nine hours per week.
2° Over and above the average thirty-five hours per week calculated over the reference period set in application of article L. 3121-45, after deduction, where applicable, of any overtime hours worked in excess of the weekly limit.
In the event of arrival or departure during the reference period, hours worked in excess of thirty-five hours per week are considered as overtime. In weeks when the working week is less than thirty-five hours, the salary is maintained on the basis of thirty-five hours per week.
In the event of paid absence, the time not worked is not recoverable and is valued on the basis of the time that would have been worked had the employee been present, including overtime.
