Article D3134-4 of the French Public Health Code

In application of article L. 3134-2-1, the secondment agreement concluded between the Agence nationale de santé publique and the public health institution specifies the nature, duration and location of the healthcare professionals seconded.

The healthcare professionals are made available to the legal entities mentioned in I of article 49 of law no. 86-33 of 9 January 1986 on statutory provisions relating to the hospital civil service.

Before it is signed, the healthcare professional concerned is sent the secondment agreement in such a way as to enable him to express his agreement, in writing, to the nature of the activities entrusted to him and the conditions under which he will carry them out.

The secondment may be granted for discontinuous periods.

En application de l’article L. 3134-2-1, la convention de mise à disposition conclue entre l’ Agence nationale de santé publique et l’établissement public de santé précise la nature, la durée et le lieu des interventions des professionnels de santé mis à disposition.


Les professionnels de santé sont mis à disposition des personnes morales mentionnées au I de l’article 49 de la loi n° 86-33 du 9 janvier 1986 portant dispositions statutaires relatives à la fonction publique hospitalière.


La convention de mise à disposition est transmise avant sa signature au professionnel de santé intéressé dans des conditions lui permettant d’exprimer, par écrit, son accord sur la nature des activités qui lui sont confiées et les conditions d’exercice.


La mise à disposition peut être prononcée pour des périodes discontinues.
