The staff concerned by the obligation of professional competence mentioned in articles L. 314-24 and L. 314-25 are natural persons who work for the creditor and who are directly involved in drawing up, offering, granting or advising on the credit agreements referred to in Articles L. 312-1 and L. 313-1, as well as natural persons who directly manage or supervise the aforementioned persons.
The relevant staff of credit intermediaries are understood within the meaning of article R. 519-15 of the Monetary and Financial Code.
However, the professional competence requirement mentioned in article L. 314-24 does not apply to staff employed under a work-linked training contract provided for in articles L. 6221-1 and L. 6325-1 of the French Labour Code for the duration of the contract, provided that they only take part in the activities mentioned in the first paragraph in the presence and under the direction of an employee with the required training or professional experience.
