In the absence of an agreement or convention mentioned in article L. 3142-117, the employee informs the employer by any means that provides a date certain, at least two months before the start of the leave or the period of part-time work for the creation or takeover of a business, of his wish to benefit from this leave or this period.
The employee must specify the business activity of the company he plans to set up or take over or of the company meeting the criteria of a young innovative company in which he plans to exercise management responsibilities.
They specify the duration of the leave or the desired reduction in their working hours.
