Article D3142-73 of the French Labour Code

In the absence of an agreement or convention mentioned in article L. 3142-117, the employee informs the employer by any means that provides a date certain, at least two months before the start of the leave or the period of part-time work for the creation or takeover of a business, of his wish to benefit from this leave or this period.

The employee must specify the business activity of the company he plans to set up or take over or of the company meeting the criteria of a young innovative company in which he plans to exercise management responsibilities.

They specify the duration of the leave or the desired reduction in their working hours.

A défaut de convention ou d’accord mentionné à l’article L. 3142-117, le salarié informe l’employeur par tout moyen conférant date certaine, au moins deux mois avant le début du congé ou de la période de travail à temps partiel pour la création ou la reprise d’entreprise, de sa volonté de bénéficier de ce congé ou de cette période.

Le salarié précise l’activité de l’entreprise qu’il prévoit de créer ou de reprendre ou de l’entreprise répondant aux critères de jeune entreprise innovante dans laquelle il prévoit d’exercer des responsabilités de direction.

Il précise la durée du congé ou la réduction souhaitée de son temps de travail.
