For the application of d of 1 of II of article 220 sexies of the General Tax Code, cinematographic or audiovisual works are considered to contribute to the development of French and European cinematographic and audiovisual creation and to its diversity if, significantly, taking into account the genre to which they belong and the conditions of their production, they are likely to promote talent and to stimulate and consolidate the presence of human resources and the technical capacities required for cinematographic and audiovisual creation.
Cinematographic or audiovisual works are mainly made with the help of authors, performers and personnel in charge of direction and production who are either French, or nationals of a Member State of the European Union, a State party to the Agreement on the European Economic Area, a State party to the European Convention on Transfrontier Television or the European Convention on Cinematographic Co-production of the Council of Europe, or a European third State with which the Union or the European Community has concluded agreements relating to the audiovisual sector. Foreigners other than the aforementioned European nationals who are French residents are treated in the same way as French citizens.
Audiovisual works must also meet the following minimum conditions in terms of length and production costs:
1° Audiovisual works belonging to the fiction genre must be at least 45 minutes long and have a production cost of at least 5,000 euros per minute produced. However, in the case of audiovisual works of fiction specifically intended for young audiences and which are the subject of a contract with a television service publisher in which the latter expressly undertakes to broadcast them at times suitable for young audiences, the production cost is greater than or equal to 3,000 euros per minute produced;
2° Audiovisual works belonging to the documentary genre are 24 minutes or longer and have a production cost greater than or equal to 2,333 euros per minute produced;
3° Audiovisual works belonging to the animation genre are 24 minutes or longer and have a production cost of 3,000 euros or more per minute produced.
4° Works belonging to the genre of audiovisual adaptation of shows lasting 40 minutes or more and whose production cost per minute produced is:
a) greater than or equal to €2,300 when they last 40 minutes or more and less than 60 minutes;
b) greater than or equal to €1,400 when they last 60 minutes or more and less than 90 minutes;
c) greater than or equal to €1,100 when they last 90 minutes or more.
