Article D3332-8-1 of the French Labour Code

The employer’s unilateral payment for the acquisition of shares or investment certificates issued by the company benefits all members who satisfy the seniority conditions, if any, set out in the plan regulations. The total amount of this payment may not exceed 2% of the annual ceiling provided for in the first paragraph of article L. 241-3 of the Social Security Code. This payment is taken into account to assess compliance with the contribution ceiling provided for in the regulations and the ceiling mentioned in article R. 3332-8 of this code.

Le versement unilatéral de l’employeur pour l’acquisition d’actions ou de certificats d’investissement émis par l’entreprise bénéficie à l’ensemble des adhérents qui satisfont aux conditions d’ancienneté éventuellement prévues par le règlement du plan. Le montant total de ce versement ne peut excéder 2 % du montant annuel du plafond prévu au premier alinéa de l’article L. 241-3 du code de la sécurité sociale. Ce versement est pris en compte pour apprécier le respect du plafond d’abondement prévu par le règlement et du plafond mentionné à l’article R. 3332-8 du présent code.
