Article D3512-9-4 of the French Public Health Code

I.-The approved laboratory shall immediately inform the public establishment referred to in Article L. 3512-15 of any situation that may no longer enable it to comply with one or more conditions of approval.

Failure to comply with one or more conditions of approval, delay in transmitting this information to the aforementioned public establishment, and false declarations are grounds for suspension or withdrawal of approval. The decision to withdraw approval is taken by the public body. The laboratory concerned shall first be given formal notice to submit its observations.

II – The public establishment referred to in Article L. 3512-15 shall assess the information provided by the laboratory when it applies for approval and each time it applies for renewal of its approval. It may ask the laboratory for any additional information required to carry out this assessment.

I.-Le laboratoire agréé informe sans délai l’établissement public mentionné à l’article L. 3512-15 de toute situation susceptible de ne plus lui permettre de satisfaire à une ou plusieurs conditions de l’agrément.


Le défaut de conformité à une ou plusieurs conditions de l’agrément, le retard de transmission de cette information à l’établissement public susmentionné, ainsi que les fausses déclarations constituent des motifs de suspension ou de retrait de l’agrément. La décision de retrait d’agrément est prise par l’établissement public. Au préalable, le laboratoire concerné est mis en demeure de présenter ses observations.


II.-L’établissement public mentionné à l’article L. 3512-15 évalue les éléments fournis par le laboratoire lors de sa demande d’agrément et à chaque demande de renouvellement de celui-ci. Il peut demander à celui-ci tout élément complémentaire nécessaire pour effectuer cette évaluation.
