Article D4162-1 of the French Labour Code

I.-The minimum proportion of employees mentioned in 1° of I of Article L. 4162-1 is set at 25% of the workforce.

II – For the application of 2° of I of article L. 4162-1 of the Labour Code, the company or group is subject to the obligation set out in this same article if its claims ratio is greater than 0.25.

This claims index is equal to the ratio, for the last three known years, between the number of accidents at work and occupational illnesses attributed to the employer, excluding accidents provided for inarticle L. 411-2 of the Social Security Code, and the number of employees in the company as defined in article R. 130-1 of the same code.

I.-La proportion minimale de salariés mentionnée au 1° du I de l’article L. 4162-1 est fixée à 25 % de l’effectif.


II.-Pour l’application du 2° du I de l’article L. 4162-1 du code du travail, l’entreprise ou le groupe est assujetti à l’obligation prévue à ce même article si son indice de sinistralité est supérieur à 0,25.


Cet indice de sinistralité est égal au rapport, pour les trois dernières années connues, entre le nombre d’accidents du travail et de maladies professionnelles imputés à l’employeur, à l’exclusion des accidents prévus à l’article L. 411-2 du code de la sécurité sociale, et l’effectif de l’entreprise tel que défini à l’article R. 130-1 du même code.
