Article D4162-3 of the French Labour Code

The company or group agreement referred to in Article L. 4162-1 or, failing that, the action plan referred to in Article L. 4162-2, or the extended branch agreement referred to in II of Article L. 4162-1 deals with:

1° At least two of the following themes:

a) Reducing multiple exposures to the factors mentioned in article D. 4161-1 ;

b) Adapting and adapting the workstation;

c) Reducing exposure to the occupational risk factors mentioned in article D. 4161-1;

2° In addition, at least two of the following themes:

a) Improving working conditions, particularly at organisational level;

b) Developing skills and qualifications;

c) Planning the end of careers;

d) Keeping employees exposed to the factors mentioned in article D. 4161-1 in employment.

For the themes mentioned in 2°, the agreement or action plan specifies the measures enabling holders of a professional prevention account to allocate the points registered in it to the uses provided for in 1° and 2° of I of article L. 4163-7.

Article D4162-3

L’accord d’entreprise ou de groupe mentionné à l’article L. 4162-1 ou, à défaut, le plan d’action mentionné à l’article L. 4162-2, ou l’accord de branche étendu mentionné au II de l’article L. 4162-1 traite :

1° D’au moins deux des thèmes suivants :

a) La réduction des polyexpositions aux facteurs mentionnés à l’article D. 4161-1 ;

b) L’adaptation et l’aménagement du poste de travail ;

c) La réduction des expositions aux facteurs de risques professionnels mentionnés à l’article D. 4161-1 ;

2° En outre, d’au moins deux des thèmes suivants :

a) L’amélioration des conditions de travail, notamment au plan organisationnel ;

b) Le développement des compétences et des qualifications ;

c) L’aménagement des fins de carrière ;

d) Le maintien en activité des salariés exposés aux facteurs mentionnés à l’article D. 4161-1.

Pour les thèmes mentionnés au 2°, l’accord ou le plan d’action précise les mesures de nature à permettre aux titulaires d’un compte professionnel de prévention d’affecter les points qui y sont inscrits aux utilisations prévues aux 1° et 2° du I de l’article L. 4163-7.
