Article D4622-21 of the French Labour Code

Unless otherwise advised by the regional director of companies, competition, consumption, labour and employment, an inter-company occupational health and prevention service may not oppose the membership of a company within its remit.

An inter-company occupational health and prevention service may accept the membership of a company located in the region where it has approval provided that the following conditions are met:

1° The company’s membership does not call into question the effective coverage of occupational medicine needs in the sectors for which the service is approved;

2° The service guarantees local access for each worker under the conditions laid down in d of 5° of I of article D. 4622-49-1.

Sauf avis contraire du directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi, un service de prévention et de santé au travail interentreprises ne peut s’opposer à l’adhésion d’une entreprise relevant de sa compétence.

Un service de prévention et de santé au travail interentreprises peut accepter l’adhésion d’une entreprise située dans la région où il dispose d’un agrément dès lors que les conditions suivantes sont réunies :

1° L’adhésion de l’entreprise ne remet pas en cause la couverture effective des besoins en médecine du travail des secteurs pour lesquels le service est agréé ;

2° Le service garantit un accès de proximité pour chaque travailleur dans les conditions prévues au d du 5° du I de l’article D. 4622-49-1.
