Article D47-1-35 of the French Code of Criminal Procedure

Where the alerts provided for in 1 to 3 and 5 of Article 24 of Council Regulation (EU) 2017/1939 of 12 October 2017 implementing enhanced cooperation in relation to the establishment of the European Public Prosecutor’s Office are, in accordance with the first sentence of Article 696-111, directly addressed to the Deputy European Public Prosecutor by the competent national authorities mentioned in Article 19, in the second paragraph of Article 40 and in Article 80 of this Code, these authorities shall then simultaneously inform:

1° The Financial Public Prosecutor provided for in Article 705, if at least one of the offences for which an alert has been issued falls within the scope of this article;

2° The Public Prosecutor with territorial jurisdiction for the inter-regional court specialising in economic and financial matters provided for in Article 704, if at least one of the offences for which an alert has been issued falls within its jurisdiction;

3° The public prosecutor with territorial jurisdiction.

When the alert concerns an offence provided for by the Customs Code, the customs administration shall be informed.

Lorsque les signalements prévus aux 1 à 3 et au 5 de l’article 24 du règlement (UE) 2017/1939 du Conseil du 12 octobre 2017 mettant en œuvre une coopération renforcée concernant la création du Parquet européen sont, conformément à la première phrase de l’article 696-111, directement adressés au procureur européen délégué par les autorités nationales compétentes mentionnées à l’article 19, au second alinéa de l’article 40 et à l’article 80 du présent code, ces autorités en informent alors simultanément :

1° Le procureur de la République financier prévu par l’article 705, si l’une au moins des infractions faisant l’objet du signalement relève de cet article ;

2° Le procureur de la République territorialement compétent près la juridiction interrégionale spécialisée en matière économique et financière prévu par l’article 704, si l’une au moins des infractions faisant l’objet du signalement relève de sa compétence ;

3° Le procureur de la République territorialement compétent.

Lorsque le signalement concerne une infraction prévue par le code des douanes, l’administration des douanes est informée.
