Article D47-37-5 of the French Code of Criminal Procedure

In accordance with article 349-1, the Assize Court answers a question worded as follows:

“Does the accused benefit, for the act of which he is accused, from the cause of irresponsibility provided for in the first paragraph of Article 122-1 of the Penal Code according to which a person who was suffering, at the time of the acts, from a psychic or neuropsychic disorder having abolished his discernment or the control of his acts is not criminally responsible? “

Conformément à l’article 349-1, la cour d’assises répond à une question ainsi formulée :

“ L’accusé bénéficie-t-il pour le fait qui lui est reproché de la cause d’irresponsabilité prévue par le premier alinéa de l’article 122-1 du code pénal selon lequel n’est pas pénalement responsable la personne qui était atteinte, au moment des faits, d’un trouble psychique ou neuropsychique ayant aboli son discernement ou le contrôle de ses actes ? ”
