Article D48-2-5 of the French Code of Criminal Procedure

The order for execution of the deferred committal order issued by the public prosecutor either at the end of the hearing or under the conditions provided for in article D. 48-2-4 refers to the conviction and the warrant issued by the criminal court or the assize court, and includes the information mentioned in the first paragraph of article D. 48-2-4 and in article D. 45-2-7. It is dated, signed and sealed by the magistrate.

A copy of this order is given to the convicted person. A certified copy of this order is sent to the head of the prison before the date set for incarceration.

L’ordre de mise à exécution du mandat de dépôt à effet différé délivré par le procureur de la République soit à l’issue de l’audience, soit dans les conditions prévues à l’article D. 48-2-4 vise la décision de condamnation rendue et le mandat décerné par le tribunal correctionnel ou la cour d’assises, et comporte les indications mentionnées au premier alinéa de l’article D. 48-2-4 et à l’article D. 45-2-7. Il est daté, signé et revêtu du sceau de ce magistrat.


Une copie de cet ordre est remise au condamné. Une copie certifiée conforme de cet ordre est adressée au chef de l’établissement pénitentiaire avant la date fixée pour l’incarcération.
