Article D49-17-1 of the French Code of Criminal Procedure

When the public prosecutor is in favour of granting a sentence adjustment measure requested by the sentenced person, he or she may address written submissions to the sentence enforcement judge asking him or her to grant this measure without proceeding to an adversarial debate, in accordance with the provisions of the second paragraph of article 712-6. If the offender and his lawyer do not request an adversarial hearing, the sentence enforcement judge will rule on the measure in the absence of the public prosecutor, after hearing the offender and his lawyer in chambers, if necessary.

Lorsque le procureur de la République est favorable à l’octroi d’une mesure d’aménagement de peine demandée par le condamné, il peut adresser au juge de l’application des peines des réquisitions écrites lui demandant d’accorder cette mesure sans procéder à un débat contradictoire, conformément aux dispositions du deuxième alinéa de l’article 712-6. Si le condamné et son avocat ne sollicitent pas qu’il soit procédé à un débat contradictoire, le juge de l’application des peines statue sur la mesure en l’absence du procureur de la République, après, le cas échéant audition du condamné et de son avocat en chambre du conseil.
