Chapter III: Courts for the enforcement of sentences

The first president of the court of appeal shall designate each year, by order, following the opinion of the general assembly of judges of the court and the opinion of the presidents of the judicial courts concerned, the enforcement judges entrusted with the duties of president or assessor of the enforcement court. When the enforcement court examines a case falling within its jurisdiction, at least one of the enforcement judges shall be from the court within whose jurisdiction the sentenced person is imprisoned or domiciled.

When the sentence enforcement court examines a case following a referral from a sentence enforcement judge in accordance with the provisions of the third paragraph of article 712-6 and that judge is absent, prevented from attending, or has been appointed to another post, he or she is replaced by a sentence enforcement judge charged with the duties of president or assessor of the sentence enforcement court.

The sentence enforcement court shall have a registry. The duties of secretary and court clerk of the court shall be performed by one or more court clerks of the judicial courts within the jurisdiction of the court of appeal where the sentence enforcement court sits, who may also perform their duties with the sentence enforcement judges.

The functions of the public prosecutor at the enforcement of sentences court are carried out by the public prosecutor at the judicial court within whose jurisdiction the court sits.
