Article D49-41-1 of the French Code of Criminal Procedure

In the event of an appeal against an order made by the sentence enforcement judge pursuant to the provisions of Article 712-5, the copy of the sentenced person’s individual file sent to the President of the Enforcement Division of the Court of Appeal shall contain only the information required to examine the appeal. In the event of an appeal against an order to withdraw a reduced sentence, only the incident report that led to the withdrawal may be included in the file. The President of the Enforcement Division may request additional documents if he considers it useful.

En cas d’appel d’une ordonnance rendue par le juge de l’application des peines en application des dispositions de l’article 712-5, la copie du dossier individuel du condamné adressé au président de la chambre de l’application des peines de la cour d’appel ne comporte que les éléments nécessaires à l’examen de l’appel. En cas d’appel contre une ordonnance de retrait d’une réduction de peine, peut ne figurer au dossier que le rapport d’incident à l’origine du retrait. Le président de la chambre de l’application des peines peut demander des pièces supplémentaires s’il l’estime utile.
