The sentence enforcement committee sitting in each prison includes the members mentioned in article 712-4-1.
The sentence enforcement judge may, with the agreement of the head of the establishment, call upon these persons either on a permanent basis or for a specific session, so that they can be heard by the committee if necessary:
1° To members of the management staff, to a member of the commanding body, to a member of the supervisory and enforcement staff and to probation and integration staff;
2° To any person fulfilling a mission in the prison, when their knowledge of individual cases or of the problems to be examined makes their presence useful.
The Sentence Enforcement Judge may order the appearance of the detainee before the Sentence Enforcement Commission so that he or she may be heard by the latter in the areas that fall within its remit.
The members of the commission as well as persons called upon in any capacity to attend its meetings are bound to secrecy with regard to third parties in all matters concerning its work.
In the absence of one of the members mentioned in Article 712-4-1, the Sentence Enforcement Commission shall not be validly convened.
The head of the establishment may be represented on the Sentence Enforcement Committee by a member of the management staff.
When the appearance of the prisoner has not been ordered, the committee may deliberate by electronic means, after checking that its members and, where applicable, the persons mentioned in 1° and 2° above have access to technical means enabling them, at a distance, simultaneously or successively and under conditions guaranteeing the confidentiality of exchanges, to make their contribution and, in the case of members, to cast their vote, before the expiry of deadlines set by the committee chairman. Except in emergencies, the committee may only give its opinion after having heard the contributions of the public prosecutor, the representative of the prison integration service and, unless the second paragraph of article 712-4-2 is applied, the head of the prison. The technical means of deliberation are specified by order of the Minister of Justice. (1)
