Article D49-27 of the French Code of Criminal Procedure

The sentence enforcement judge sets the main terms and conditions for the enforcement of custodial sentences or certain sentences restricting freedom by guiding and monitoring the conditions of their enforcement, in accordance with the principles laid down by article 707.

To this end, he is assisted by the Sentence Enforcement Commission, as well as by the Penitentiary Integration and Probation Service, which the magistrate mandates to monitor convicts subject to a custodial sentence.

The sentence enforcement judge carries out the tasks entrusted to him, in particular by determining, for each convicted offender, the main terms and conditions of prison treatment, in compliance with the powers of the inter-regional director of prison services and the heads of prisons relating to the organisation and operation of these establishments.

Le juge de l’application des peines fixe les principales modalités d’exécution des peines privatives de liberté ou de certaines peines restrictives de libertés en orientant et en contrôlant les conditions de leur exécution, conformément aux principes fixés par l’article 707.

Il est à cette fin assisté par la commission de l’application des peines, ainsi que par le service pénitentiaire d’insertion et de probation, que le magistrat mandate pour suivre les condamnés faisant l’objet d’une peine restrictive de liberté.

Le juge de l’application des peines exerce les missions qui lui sont confiées, en déterminant notamment, pour chaque condamné, les principales modalités du traitement pénitentiaire, dans le respect des attributions propres au directeur interrégional des services pénitentiaires et aux chefs des établissements pénitentiaires relatives à l’organisation et au fonctionnement de ces établissements.
