Article D49-5-1 of the French Code of Criminal Procedure

When the sentence enforcement court examines a case following a referral from a sentence enforcement judge in accordance with the provisions of the third paragraph of article 712-6 and that judge is absent, prevented from attending, or has been appointed to another post, he or she is replaced by a sentence enforcement judge charged with the duties of president or assessor of the sentence enforcement court.

Lorsque le tribunal de l’application des peines examine une affaire à la suite d’un renvoi d’un juge de l’application des peines conformément aux dispositions du troisième alinéa de l’article 712-6 et que ce juge est absent, empêché, ou a été nommé à un autre poste, il est remplacé par un juge de l’application des peines chargé des fonctions de président ou d’assesseur du tribunal de l’application des peines.
