Article D49-40 of the French Code of Criminal Procedure

When the sentence enforcement judge or court grants one of the measures mentioned in articles 712-5,712-6 and 712-7, the measure may not be enforced until twenty-four hours have elapsed from notification of the decision to the public prosecutor, in the absence of a visa from the latter indicating that he or she is not appealing; if the public prosecutor lodges an appeal within twenty-four hours of notification, he or she shall immediately inform the sentence enforcement judge and the head of the prison. The twenty-four hour period expires at midnight on the day after the decision was notified.

The provisions of this article also apply to decisions ordering a release under constraint.

Lorsque le juge ou le tribunal de l’application des peines accorde l’une des mesures mentionnées aux articles 712-5,712-6 et 712-7, la mise à exécution de la mesure ne peut intervenir, avant l’expiration du délai de vingt-quatre heures à compter de la notification de la décision au magistrat du ministère public, en l’absence de visa de ce dernier indiquant qu’il ne fait pas appel ; si le procureur de la République forme appel dans les vingt-quatre heures de la notification, il en informe immédiatement le juge de l’application des peines et le chef de l’établissement pénitentiaire. Le délai de vingt-quatre heures expire à minuit, le lendemain du jour où la décision a été notifiée.

Les dispositions du présent article sont également applicables aux décisions ordonnant une libération sous contrainte.
