Article D49-81-2 of the French Code of Criminal Procedure

The matter is referred to the commission by the sentence enforcement judge or the sentence enforcement court. The sentenced person and his/her counsel as well as the public prosecutor are informed of this referral by the sentence enforcement judge or the sentence enforcement court.

The commission will issue a reasoned opinion within three months of the referral. In the absence of an opinion within this timeframe, the judge or sentence enforcement court may have the dangerousness assessment provided for in article 720-5 carried out. The offender is notified of this by registered letter or, if he or she is a prisoner, by the head of the prison. His lawyer and the public prosecutor are informed by the sentence enforcement judge or the sentence enforcement court.
