Article D49-81-3 of the French Code of Criminal Procedure

The commission may request the appearance of the sentenced person before giving its opinion. This appearance may be made by a means of telecommunication in accordance with the provisions of article 706-71. The convicted person may be assisted by a lawyer.

According to the decision of its Chairman, who is responsible for its implementation, the Commission may also carry out or arrange for the carrying out of any examinations, hearings, administrative enquiries, expert reports or other useful measures throughout France.

La commission peut demander la comparution du condamné avant de donner son avis. Cette comparution peut se faire par un moyen de télécommunication conformément aux dispositions de l’article 706-71. Le condamné peut être assisté de son avocat.


Sur décision de son président, qui en assure la mise en œuvre, la commission peut également procéder ou faire procéder sur l’ensemble du territoire national à tous examens, auditions, enquêtes administratives, expertises ou autres mesures utiles.
