Article D49-93 of the French Code of Criminal Procedure

Where the person sentenced to a measure of penal restraint must comply with the obligation to refrain from appearing in a specially designated place or area, in order to avoid contact with the victim or the civil party, or the obligation to refrain from entering into contact with the victim or the civil party, provided for in 9°, 13° and 19° of Article 132-45 of the Criminal Code, the sentence enforcement judge may decide, as part of the powers he or she derives from Article 712-16, to notify or have notified the victim or the civil party, directly or through their lawyer, of the end date of the constraint period.

Whether or not a civil party was involved in the proceedings, the victim may ask to be informed of the end of the constraint period. They may, by registered letter with acknowledgement of receipt, make their change of address known to the public prosecutor or the public prosecutor at the court that handed down the sentence.

This information is forwarded by the public prosecutor to the sentenced person’s enforcement judge to be filed in the “victim” section of the individual file provided for by Article D. 49-29.

The victim or civil party may request that this information remain confidential and not be communicated to the convicted person or his lawyer.

Lorsque le condamné à une mesure de contrainte pénale doit satisfaire à l’obligation de s’abstenir de paraître dans un lieu ou une zone spécialement désigné, afin d’éviter un contact avec la victime ou la partie civile, ou à l’obligation de s’abstenir d’entrer en relation avec la victime ou la partie civile, prévues aux 9°, 13° et 19° de l’article 132-45 du code pénal, le juge de l’application des peines peut décider, dans le cadre des pouvoirs qu’il tient de l’article 712-16, d’aviser ou de faire aviser la victime ou la partie civile, directement ou par l’intermédiaire de son avocat, de la date de fin de la contrainte pénale.

Qu’elle se soit ou non constituée partie civile lors de la procédure, la victime peut demander à être informée de la fin de la contrainte pénale. Elle peut, par lettre recommandée avec accusé de réception, faire connaître ses changements d’adresse auprès du procureur de la République ou du procureur général près la juridiction qui a prononcé la condamnation.

Ces informations sont transmises par le ministère public au juge de l’application des peines dont relève le condamné pour être classées dans la cote ” victime ” du dossier individuel prévu par l’article D. 49-29.

La victime ou la partie civile peut demander que ces informations demeurent confidentielles et qu’elles ne soient pas communiquées au condamné ou à son avocat.
