Article D5122-13 of the French Labour Code

The hourly rate of the partial activity allowance for each employee concerned is equal to 36% of gross hourly pay as calculated in article R. 5122-12, limited to 4.5 times the hourly rate of the interprofessional minimum growth wage.

This hourly rate may not be less than 8.21 euros. This minimum is not applicable when their remuneration is less than the interprofessional minimum growth wage, to employees on apprenticeship or professionalisation contracts, to freelance journalists working on a regular basis within the scope of application of article L. 7112-1 and to employees mentioned in Title I of Book III of Part Seven of this Code.

Le taux horaire de l’allocation d’activité partielle est égal pour chaque salarié concerné à 36 % de la rémunération horaire brute telle que calculée à l’article R. 5122-12, limitée à 4,5 fois le taux horaire du salaire minimum interprofessionnel de croissance.

Ce taux horaire ne peut être inférieur à 8,21 euros. Ce minimum n’est pas applicable lorsque leur rémunération est inférieure au salaire minimum interprofessionnel de croissance, aux salariés en contrat d’apprentissage ou de professionnalisation, aux journalistes pigistes en collaboration régulière entrant dans le champ d’application de l’article L. 7112-1 et aux salariés mentionnés au titre Ier du livre III de la septième partie du présent code.
