Article D5125-24-16 of the French Public Health Code

Pharmacists holding a dispensary or companies operating a dispensary may form a company, an economic interest grouping or an association, with a view to purchasing, on behalf of its partners, members or members who are pharmacists holding a dispensary or companies operating a dispensary, medicinal products other than experimental medicinal products, with the exception of medicinal products reimbursable by compulsory health insurance schemes. This structure may engage in the same activity for goods other than medicinal products listed in the order referred to in article L. 5125-24.

The structure referred to in the first paragraph may only purchase, in its own name and on its own behalf, and store medicinal products with a view to their wholesale distribution to its associates, members or subscribers, if it includes a pharmaceutical establishment authorised for the activity of wholesale distribution.

Les pharmaciens titulaires d’officine ou les sociétés exploitant une officine peuvent constituer une société, un groupement d’intérêt économique ou une association, en vue de l’achat, d’ordre et pour le compte de ses associés, membres ou adhérents pharmaciens titulaires d’officine ou sociétés exploitant une officine, de médicaments autres que des médicaments expérimentaux, à l’exception des médicaments remboursables par les régimes obligatoires d’assurance maladie. Cette structure peut se livrer à la même activité pour les marchandises autres que des médicaments figurant dans l’arrêté mentionné à l’article L. 5125-24.

La structure mentionnée au premier alinéa ne peut se livrer aux opérations d’achat, en son nom et pour son compte, et de stockage des médicaments en vue de leur distribution en gros à ses associés, membres ou adhérents, que si elle comporte un établissement pharmaceutique autorisé pour l’activité de distribution en gros.
