Article D5134-1 of the French Public Health Code

The dispensing to minors of medicinal products indicated for emergency contraception and not subject to compulsory medical prescription by virtue of the second paragraph of article L. 5134-1 is carried out in conditions of confidentiality allowing a conversation to take place without the risk of third parties.

In addition to complying with the provisions of article R. 4235-48, dispensing by the pharmacist is preceded by an interview to ensure that the minor’s situation meets the emergency criteria and the conditions for use of this contraception. The interview also enables the pharmacist to provide the minor with information on access to regular contraception, the prevention of sexually transmitted diseases and the benefits of medical follow-up. This information is supplemented by the pharmacist’s documentation on these subjects. The pharmacist will also give the minor the contact details of the nearest family planning or education centre.

La délivrance aux mineures des médicaments indiqués dans la contraception d’urgence et non soumis à prescription médicale obligatoire en vertu du deuxième alinéa de l’article L. 5134-1 est effectuée dans les conditions de confidentialité permettant la tenue d’une conversation à l’abri des tiers.

Outre le respect des dispositions de l’article R. 4235-48, la délivrance par le pharmacien est précédée d’un entretien tendant à s’assurer que la situation de la personne mineure correspond aux critères d’urgence et aux conditions d’utilisation de cette contraception. L’entretien permet également au pharmacien de fournir à la mineure une information sur l’accès à une contraception régulière, sur la prévention des maladies sexuellement transmissibles et sur l’intérêt d’un suivi médical. Cette information est complétée par la remise de la documentation dont dispose le pharmacien sur ces sujets. Le pharmacien communique également à la mineure les coordonnées du centre de planification ou d’éducation familiale le plus proche.
