Without prejudice to the provisions of Article D. 523, the sentence enforcement judge shall gather the information necessary to examine the application for conditional release. To this end, he may apply the provisions of article 712-16.
In all cases, the sentence enforcement judge may also seek the opinion of the public prosecutor of the judicial court within whose jurisdiction the sentenced person wishes to establish residence. The public prosecutor may then carry out the investigations provided for in the first paragraph of this article in order to give his opinion.
For cases concerning military personnel sentenced by one of the courts mentioned in Article 697 or a court of the armed forces, the sentence enforcement judge shall also obtain the opinion of the Minister of Defence.
These various documents or opinions are placed in the convicted person’s individual file, which is forwarded to the sentence enforcement court when the latter has jurisdiction.
In the latter case, the sentence enforcement judge will orally present a summary of these documents and opinions during the adversarial debate before the sentence enforcement court.
