Lorsqu’ils sont saisis, le tribunal de l’application des peines et la chambre de l’application des peines de la cour d’appel, ou les présidents de ces juridictions, peuvent également procéder ou faire procéder à des mesures d’instruction complémentaires. La juridiction qui envisage d’accorder une libération conditionnelle est tenue de demander l’avis du procureur de la République du tribunal judiciaire dans le ressort duquel le condamné souhaite établir sa résidence si cet avis ne figure pas déjà dans le dossier.
