Article D571-3 of the French Code of Criminal Procedure

The public prosecutor at the court that handed down the sentence shall be notified, either by the magistrate who takes the decision or, where the decision is taken by the criminal court, by the public prosecutor at that court:

1° Of any transmission of the case file to the competent sentence enforcement judge following a change of residence of the person sentenced to a residence ban;

2° Of any change to the list of prohibited places and surveillance measures decided pursuant to Article 762-4 ;

3° Of any provisional suspension of the enforcement of the residence ban decided pursuant to Article 762-5, paragraph 1;

4° Any provisional authorisation to stay in a prohibited locality decided pursuant to article 762-5, paragraph 2;

5° Any search order issued against the convicted person pursuant to the combined provisions of articles 762-2, paragraph 2, and 741, paragraph 2.

6° Of any conviction for breach of a residence ban.

In the event of a conviction for an offence involving a ban on residence, the public prosecutor at the court that handed down the conviction shall also notify the sentence enforcement judge under whose supervision the person convicted of a ban on residence is placed.

The Public Prosecutor’s Office at the court that handed down the conviction shall ensure that the information referred to in 2°, 3° and 4° is transmitted to the wanted persons file with a view to its dissemination.

Le ministère public près la juridiction qui a prononcé la condamnation est avisé, soit par le magistrat qui prend la décision, soit, lorsque celle-ci est prise par le tribunal correctionnel, par le procureur de la République près ce tribunal :

1° De toute transmission de dossier au juge de l’application des peines compétent à la suite d’un changement de résidence du condamné à l’interdiction de séjour ;

2° De toute modification de la liste des lieux interdits et des mesures de surveillance décidée en application de l’article 762-4 ;

3° De toute suspension provisoire de l’exécution de la mesure d’interdiction de séjour décidée en application de l’article 762-5, alinéa 1er ;

4° De toute autorisation provisoire de séjourner dans une localité interdite décidée en application de l’article 762-5, alinéa 2 ;

5° De tout ordre de recherche délivré à l’encontre du condamné en application des dispositions combinées des articles 762-2, alinéa 2, et 741, alinéa 2.

6° De toute condamnation pour infraction à l’interdiction de séjour.

En cas de condamnation pour infraction à l’interdiction de séjour, le ministère public près la juridiction qui a prononcé la condamnation en avise en outre le juge de l’application des peines sous le contrôle duquel le condamné à l’interdiction de séjour est placé.

Le ministère public près la juridiction qui a prononcé la condamnation assure la transmission des informations visées aux 2°, 3° et 4° au fichier des personnes recherchées en vue de leur diffusion.
