Article D600-2 of the French Code of Criminal Procedure

For its application in Saint-Pierre-et-Miquelon, Article D. 577 shall read as follows:

“Art. D. 577 -The sentence enforcement judge, the public prosecutor and the other instructing magistrates will communicate, for each case referred to the prison integration and probation counsellor, specific instructions relating to the purpose of the measure and the content of the obligations to be met.

“The director of prison services will communicate to the prison integration and probation counsellor, for each case referred to the prison integration and probation counsellor, specific instructions relating to the purpose of the measure and the content of the obligations to be met.
“The Director of Overseas Prison Services will define the terms and conditions for the care of persons placed under judicial supervision. After notifying the magistrate in charge, who may make any useful observations, these care arrangements are implemented by the prison integration and probation counsellor.
“The sentence enforcement judge or the instructing magistrate shall report to the inter-regional director, head of the overseas prison services mission, any difficulties that he or she observes in the management of measures and, where appropriate, shall request that this authority send him or her a report in response. “

“ Art. D. 577.-Le juge de l’application des peines, le procureur de la République et les autres magistrats mandants communiquent, pour chaque dossier dont le conseiller pénitentiaire d’insertion et de probation est saisi, des instructions particulières relatives à la finalité de la mesure et au contenu des obligations à respecter.


“ Le directeur des services pénitentiaires d’outre-mer définit les modalités de la prise en charge des personnes placées sous-main de justice. Après en avoir avisé le magistrat mandant qui peut, le cas échéant, faire toutes observations utiles, ces modalités de prise en charge sont mises en œuvre par le conseiller pénitentiaire d’insertion et de probation.


“ Le juge de l’application des peines ou le magistrat mandant signale au directeur interrégional, chef de la mission des services pénitentiaires de l’outre-mer toute difficulté qu’il constate dans la prise en charge des mesures et, s’il y a lieu, demande à cette autorité qu’elle lui adresse un rapport en réponse. ”
