Article D611-7 of the French Commercial code

Approval is granted for a maximum period of three years, renewable by order of the prefect of the region where the group’s head office is located.

The decision takes into account in particular:

The compliance of the grouping’s objectives with those defined by article L. 611-1 ;

The adequacy of the means implemented to the objectives pursued;

The commitments entered into pursuant to article D. 611-5, their compliance in the event of an application for renewal;

Guarantees of good character offered by the directors, managers, administrators and any persons acting on behalf of the grouping and their experience in analysing accounting and financial information and in managing companies.

Authorisation may be withdrawn, using the same procedure as that for granting it, if the conditions set out in article D. 611-5 are no longer met.

Article D611-7

L’agrément est accordé pour une durée maximale de trois ans renouvelable par arrêté du préfet de la région où est situé le siège du groupement.

La décision tient compte notamment :

De la conformité des objectifs du groupement à ceux définis par l’article L. 611-1 ;

De l’adéquation des moyens mis en oeuvre aux objectifs poursuivis ;

Des engagements souscrits en application de l’article D. 611-5, de leur respect en cas de demande de renouvellement ;

Des garanties de bonne moralité offertes par les dirigeants, gérants, administrateurs et toutes personnes intervenant au nom du groupement et de leur expérience dans l’analyse des informations comptables et financières ainsi que dans la gestion des entreprises.

L’agrément peut être retiré, selon une procédure identique à celle de son octroi dès lors que les conditions fixées à l’article D. 611-5 ne sont plus respectées.
