Article D6112-2 of the French Labour Code

The training courses leading to certification necessary to obtain the certification relating to the skills acquired in the exercise of a staff representative mandate or a trade union mandate, in particular the positioning, support and skills assessment courses, constitute actual working time and give rise during their course to the company maintaining remuneration, in accordance with the provisions of article L. 6321-6, provided that they do not fall within the exceptions provided for in 1° and 2° of this same article.

Les actions de formation certifiantes nécessaires à l’obtention de la certification relative aux compétences acquises dans l’exercice d’un mandat de représentant du personnel ou d’un mandat syndical, notamment les actions de positionnement, d’accompagnement et d’évaluation des compétences, constituent un temps de travail effectif et donnent lieu pendant leur déroulement au maintien par l’entreprise de la rémunération, conformément aux dispositions de l’article L. 6321-6, dès lors qu’elles ne relèvent pas des exceptions prévues aux 1° et 2° de ce même article.
