Article D6124-133-11 of the French Public Health Code

The holder has an organisation enabling the radiotherapy team to:

1° Organise continuity of care on site for the patients it treats. This organisation may be pooled by agreement with another holder or authorised radiotherapy centre by setting up a joint team as referred to in II of Article D. 6124-133.

2° To guarantee continuity of radiotherapy treatment for the patients it treats, in the event of unavailability of radiotherapy equipment or temporary closure of the radiotherapy unit. Where appropriate, this organisation may be ensured by an agreement with another holder of an authorisation for cancer treatment by radiotherapy. The agreement is sent without delay to the regional health agency and to the competent territorial delegation of the Nuclear Safety Authority.

The organisation by agreement referred to in point 2 is compulsory for radiotherapy sites that are exempt from this requirement on the grounds of geographical exception.

Le titulaire dispose d’une organisation permettant à l’équipe de radiothérapie :

1° D’organiser sur place la continuité des soins des patients qu’il traite. Cette organisation peut être mutualisée par voie de convention avec un autre titulaire ou centre de radiothérapie autorisé par la mise en place d’une équipe commune visée au II de l’article D. 6124-133.

2° De garantir la continuité des traitements de radiothérapie des patients qu’il traite, en cas d’indisponibilité d’un équipement de radiothérapie ou de fermeture temporaire de l’unité de radiothérapie. Le cas échéant, cette organisation peut être assurée par convention avec un autre titulaire d’autorisation de traitement du cancer par radiothérapie. La convention est transmise sans délai à l’agence régionale de santé et à la délégation territoriale compétente de l’Autorité de sûreté nucléaire.

L’organisation par convention mentionnée au 2 est obligatoire pour les sites dérogatoires de radiothérapie pour exception géographique.
