Article D6124-200 of the French Public Health Code

I.-The attending physician, or failing this the physician designated by the patient, is the patient’s medical referent during the stay. His or her agreement is sought prior to the patient being cared for.

II.- By way of derogation from I, if the doctor is unavailable or if the urgency of the situation justifies it, the patient may be cared for without the agreement of the attending doctor, or the doctor designated by the patient. In this case, the hospital at home doctor is designated as the referral doctor. He informs the doctor mentioned in I and makes a note of this in the patient’s file.

In order to carry out the tasks of the patient’s referring doctor, the hospital at home doctor must be able to carry out an intervention in the patient’s home or a telehealth activity as defined in articles L. 6316-1 and L. 6316-2.

I.-Le médecin traitant, ou à défaut le médecin désigné par le patient, est le référent médical du patient pendant le séjour. Son accord est sollicité préalablement à la prise en charge.

II.-Par dérogation au I, en cas d’indisponibilité du médecin ou lorsque l’urgence de la situation le justifie, le patient peut être pris en charge sans que l’accord du médecin traitant, ou du médecin désigné par le patient, ait été recueilli. Dans ce cas, le médecin praticien d’hospitalisation à domicile est désigné référent de la prise en charge. Il en informe le médecin mentionné au I et en fait mention dans le dossier du patient.

Pour réaliser les missions du médecin référent du patient, le médecin praticien d’hospitalisation à domicile doit être en mesure de réaliser une intervention au domicile du patient ou une activité de télésanté définie aux articles L. 6316-1 et L. 6316-2.
