Article D6124-283 of the French Public Health Code

When the holder of the authorisation for the surgical care activity referred to in 1° of I of article R. 6123-202 provides care for children under III of the same article, it must comply with the provisions of article D. 6124-284 and organise paediatric care, with appropriate reception facilities, in premises that allow children to be hospitalised full time, day or night, separately from adults.

When it cares for children under the terms of IV of article R. 6123-202, it has a doctor specialising in surgery for the specific therapeutic practice concerned, with initial training and experience in paediatric surgery, and a doctor specialising in anaesthesia-intensive care with experience in anaesthesia in the context of paediatric surgical care.

Lorsque le titulaire de l’autorisation d’activité de soins de chirurgie mentionnée au 1° du I de l’article R. 6123-202 prend en charge des enfants au titre du III du même article, il respecte les dispositions prévues à l’article D. 6124-284 et organise la prise en charge pédiatrique, avec un accueil adapté, dans des locaux permettant une hospitalisation des enfants à temps complet de jour ou de nuit, différenciée de celle des adultes.

Lorsqu’il prend en charge des enfants au titre du IV de l’article R. 6123-202, il dispose d’un médecin spécialisé en chirurgie pour la pratique thérapeutique spécifique concernée justifiant d’une formation initiale et d’une expérience en chirurgie pédiatrique et d’un médecin spécialisé en anesthésie-réanimation justifiant d’une expérience en anesthésie dans le cadre d’une prise en charge chirurgicale pédiatrique.
