Article D6124-46 of the French Public Health Code

During their stay in the in-patient sector, the mother and child benefit from the possibility of intervention every day of the year, twenty-four hours a day, including in emergencies, by a paediatrician, a gynaecologist-obstetrician and an anaesthetist-resuscitator.

The unit is organised in such a way as to be able to call on the services of a psychologist or psychiatrist as required.

The number of staff working in the inpatient sector depends on the activity of the obstetrics unit. Whatever the activity of the sector, it may not be less than one midwife, assisted by a nursing auxiliary and a childcare auxiliary during the day and one midwife or one nurse, assisted by a childcare auxiliary, at night.

Except where the provisions of the penultimate paragraph of 1° and 3° of article D. 6124-44 are applied for obstetrics units with less than 500 births per year, these are staff assigned to the hospitalisation sector who cannot have other concomitant tasks in another sector or unit.

Lors de leur séjour en secteur d’hospitalisation, la mère et l’enfant bénéficient de la possibilité d’intervention tous les jours de l’année, vingt-quatre heures sur vingt-quatre, y compris en urgence, d’un pédiatre, d’un gynécologue-obstétricien et d’un anesthésiste-réanimateur.

L’unité met en place une organisation lui permettant de s’assurer en tant que de besoin, selon le cas, du concours d’un psychologue ou d’un psychiatre.

Le personnel intervenant dans le secteur d’hospitalisation est fonction de l’activité de l’unité d’obstétrique. Il ne peut être inférieur, quelle que soit l’activité du secteur, à une sage-femme, assistée d’un aide-soignant et d’une auxiliaire de puériculture le jour et à une sage-femme ou un infirmier ou une infirmière, assisté d’une auxiliaire de puériculture, la nuit.

Sauf application des dispositions prévues à l’avant-dernier alinéa du 1° et au 3° de l’article D. 6124-44 pour les unités d’obstétrique réalisant moins de 500 naissances par an, il s’agit de personnels affectés au secteur d’hospitalisation et ne pouvant avoir d’autres tâches concomitantes dans un autre secteur ou une autre unité.
