Article D6224-2 of the French Labour Code

On receipt of the contract, the Skills Operator decides whether or not it will be funded. To this end, it checks that the contract meets the conditions laid down by :

1° Article L. 6211-1 relating to courses eligible for apprenticeship;

2° Articles L. 6222-1 to L. 6222-3 relating to the age of the apprentice;

3° The first paragraph of article L. 6223-8-1 relating to the apprenticeship master;

4° Article D. 6222-26 relating to apprentice pay.

If it finds that one or more of these conditions have not been met, the skills operator will refuse to pay for the contract in a reasoned decision that it will notify to the parties and to the apprentice training centre. The decision may be notified by electronic means.

A réception du contrat, l’opérateur de compétences se prononce sur la prise en charge financière. Il vérifie à cet effet que le contrat satisfait aux conditions posées par :


1° L’article L. 6211-1 relatif aux formations éligibles à l’apprentissage ;


2° Les articles L. 6222-1 à L. 6222-3 relatifs à l’âge de l’apprenti ;


3° Le premier alinéa de l’article L. 6223-8-1 relatif au maître d’apprentissage ;


4° L’article D. 6222-26 relatif à la rémunération des apprentis.


S’il constate la méconnaissance d’une ou plusieurs de ces conditions, l’opérateur de compétences refuse la prise en charge financière du contrat par une décision motivée qu’il notifie aux parties ainsi qu’au centre de formation d’apprentis. La notification peut être faite par voie dématérialisée.
