Article D6322-46 of the French Public Health Code

The holder of the authorisation for the cosmetic surgery facilities must ensure the permanence and continuity of care for the persons who are received there and for those who have been treated there.

When the holder of the authorisation is not in a position to provide immediate care for any medical complications in an emergency, in its facilities or, where applicable, in the health establishment where they are located, it shall enter into an agreement for this purpose with a public or private health establishment holding the authorisations referred to in articles R. 6123-1 and R. 6123-37. This agreement defines in particular the conditions under which the patient is transferred to this establishment if necessary.

Le titulaire de l’autorisation relative aux installations de chirurgie esthétique assure la permanence et la continuité des soins aux personnes qui y sont accueillies et à celles qui y ont été traitées.

Lorsque le titulaire de l’autorisation n’est pas en mesure d’assurer d’urgence, dans ses installations ou, le cas échéant, dans l’établissement de santé où elles sont situées, la prise en charge immédiate d’une éventuelle complication médicale, il conclut à cette fin une convention avec un établissement de santé public ou privé titulaire des autorisations mentionnées aux articles R. 6123-1 et R. 6123-37. Cette convention définit notamment les conditions dans lesquelles le patient est, en cas de besoin, transféré dans cet établissement.
